The small claims procedure

The small claims procedure is a simple way of settling minor civil disputes, such as a quarrel over a small sum of money, without spending a lot on lawyers. It is designed to be quick, low cost and easy for ordinary people to use, so that small problems can be sorted out without a full court case.

A small claims hearing is informal. It is usually held in front of a judge in an ordinary room, with both sides sitting around a table rather than in a formal courtroom. The procedure is for lower value claims, for example through the County Court in England and Wales. It is not used for serious criminal trials. For the test, remember that the small claims procedure is an informal, inexpensive way to settle minor disputes without a lot of legal cost.
